PhuseDraft, LLC (“PhuseDraft,” “we,” “us,” or “our”) respects your privacy and is committed to protecting your personal information and creative work.

PhuseDraft is a screenwriting and story-development platform designed to help writers develop ideas, characters, story structures, beat sheets, screenplay outlines, and other creative materials.

This Privacy Policy explains what information we collect, how we use it, how it may be processed by our service providers, how we protect it, and the rights you may have regarding your information.

PhuseDraft, LLC is a limited liability company organized under the laws of the State of New Mexico, United States.

By using the PhuseDraft website, application, or related services (collectively, the “Services”), you acknowledge that you have read and understood this Privacy Policy.

PhuseDraft determines how and why personal information is processed in connection with its Services and may therefore act as a data controller, business, or equivalent entity under applicable privacy laws.

Where PhuseDraft processes personal information solely on behalf of another organisation, PhuseDraft may act as a data processor, service provider, or equivalent entity.

2. Information We Collect

We collect information reasonably necessary to provide, secure, maintain, and improve the Services.

2.1 Account Information

When you create or maintain a PhuseDraft account, we may collect:

  • Name or display name;

  • Email address;

  • Username;

  • Authentication information;

  • Account preferences;

  • Subscription status; and

  • Other information you voluntarily provide.

2.2 Creative Content

PhuseDraft allows users to create and store creative projects.

You may submit or generate:

  • Story ideas;

  • Loglines;

  • Synopses;

  • Character descriptions;

  • Character profiles;

  • Plot points;

  • Story structures;

  • Beat sheets;

  • Scene descriptions;

  • Screenplay outlines;

  • Dialogue;

  • World-building information;

  • Notes;

  • Draft material; and

  • Other creative content.

We refer to this information collectively as “User Content.”

User Content may contain personal information, confidential information, unpublished creative work, or information relating to other individuals.

You should only submit information that you have the right to provide to PhuseDraft.

2.3 Payment Information

When you subscribe to PhuseDraft or purchase a paid service, payment transactions are processed through Dodo Payments, which provides payment and Merchant of Record services.

PhuseDraft may receive information such as:

  • Name;

  • Email address;

  • Billing information;

  • Subscription information;

  • Transaction identifier;

  • Payment status;

  • Amount paid;

  • Currency;

  • Purchase history; and

  • Other transaction-related information.

Payment-card information may be processed directly by Dodo Payments or its payment-service providers rather than being stored directly by PhuseDraft.

Dodo Payments acts as Merchant of Record for merchants using its platform and handles functions including payment processing, invoicing, taxes, refunds, and disputes.

3. Technical and Usage Information

When you access the Services, we and our service providers may automatically collect technical information such as:

  • IP address;

  • Browser type;

  • Device type;

  • Operating system;

  • Device identifiers;

  • Date and time of access;

  • Pages and features accessed;

  • Session information;

  • Error reports;

  • Performance information;

  • Security logs; and

  • Other diagnostic information.

This information may be used to operate the Services, maintain security, detect abuse, diagnose problems, and improve reliability.

4. How We Use Your Information

PhuseDraft may use information to:

  1. Create and manage your account.

  2. Authenticate users.

  3. Provide the Services.

  4. Store and retrieve your projects.

  5. Process your requests.

  6. Generate AI-assisted outputs.

  7. Process subscriptions and payments.

  8. Provide customer support.

  9. Communicate with you regarding your account and the Services.

  10. Detect fraud, abuse, and security incidents.

  11. Monitor and improve platform performance.

  12. Diagnose technical problems.

  13. Develop and improve the Services.

  14. Produce aggregated or de-identified information where appropriate.

  15. Comply with applicable legal obligations.

  16. Establish, exercise, or defend legal claims.

  17. Protect the rights, property, security, and safety of PhuseDraft, its users, and others.

5. Your Creative Work and Intellectual Property

5.1 You Retain Ownership of Your User Content

You retain ownership of the User Content you submit to PhuseDraft.

PhuseDraft does not claim ownership of your:

  • Story ideas;

  • Characters;

  • Screenplays;

  • Plot concepts;

  • Beat sheets;

  • Outlines;

  • Notes;

  • World-building;

  • Or other creative materials

merely because you use the Services.

Your use of PhuseDraft does not, by itself, transfer ownership of your creative work to PhuseDraft.

5.2 Limited Rights Required to Operate PhuseDraft

In order to provide the Services, PhuseDraft and its authorised service providers may need to technically store, transmit, reproduce, process, format, or otherwise handle User Content.

You grant PhuseDraft a limited, non-exclusive licence to perform those technical functions.

This licence is intended to allow PhuseDraft to operate, maintain, secure, and provide the Services and does not transfer ownership of your underlying creative work to PhuseDraft.

5.3 AI-Generated Content

PhuseDraft may generate content using artificial intelligence based on your instructions and User Content.

PhuseDraft does not claim ownership of AI-generated output merely because the output was generated through the Services.

However, the copyrightability and ownership of AI-generated material may vary according to applicable law, the degree of human authorship, originality, and other circumstances.

PhuseDraft therefore does not guarantee that every AI-generated output will qualify for copyright protection or will be exclusively owned by you.

You are responsible for reviewing and determining how you use generated content.

6. Artificial Intelligence Processing

PhuseDraft uses the OpenAI API to provide certain AI-powered features.

When you request an AI-powered function, relevant information may be transmitted to OpenAI for processing.

This may include:

  • Prompts;

  • Story information;

  • Character information;

  • User Content necessary to complete your request;

  • Relevant project information; and

  • The information required to generate the requested output.

6.1 OpenAI API Data

PhuseDraft uses OpenAI's API rather than consumer ChatGPT accounts for its application-level AI processing.

OpenAI states that data submitted through its API is not used to train or improve its models by default, unless the customer explicitly opts into applicable data-sharing programs.

PhuseDraft does not intentionally opt in to OpenAI programs that permit our users' private prompts, User Content, or API outputs to be used to train OpenAI's general-purpose models.

6.2 OpenAI Retention

Under OpenAI's standard API data-retention practices, API inputs and outputs may be retained for up to 30 days for purposes including providing the service and abuse monitoring, subject to endpoint-specific exceptions and applicable legal requirements.

This OpenAI retention period is separate from PhuseDraft's own retention of information in its application database.

Where available and appropriate to PhuseDraft's use case, we may configure eligible API endpoints or services for Zero Data Retention or other reduced-retention arrangements.

OpenAI currently states that eligible API customers can request Zero Data Retention for supported endpoints.

6.3 Important Limitation

AI processing necessarily involves transmitting relevant information to the AI provider.

Therefore, users who do not want their information transmitted to an external AI service should not use PhuseDraft's AI-powered features.

7. Base44 and Application Infrastructure

PhuseDraft was developed and is operated using Base44, which provides application-development and infrastructure services.

Depending on the configuration of the PhuseDraft application, Base44 and its infrastructure providers may process information necessary to host, operate, secure, maintain, monitor, and provide the application.

Base44's current security documentation states that application data is stored in the United States by default and that its platform provides encryption in transit and at rest. Base44 also identifies infrastructure and service providers used within its platform ecosystem, including cloud hosting, databases, monitoring, analytics, logging, and AI services.

Base44's privacy documentation states that it may process information supplied by platform users, including account information, input data, and usage information.

Accordingly, information submitted to PhuseDraft may be processed through Base44's infrastructure and applicable subprocessors.

8. Base44 and Use of Customer Data

PhuseDraft's relationship with Base44 is governed by the applicable Base44 terms, configuration, and data-processing arrangements.

Base44's current Terms of Service contain broad provisions concerning Customer Data and Generated Output, including processing necessary to operate and improve Base44 services and, under its current terms, training Base44 software tools.

PhuseDraft does not intentionally provide your private User Content to Base44 for the purpose of training a public foundation AI model.

However, because Base44 operates the underlying application infrastructure, certain information may be processed by Base44 and its authorised infrastructure providers as necessary to provide the platform.

PhuseDraft will use available privacy, security, and data-processing controls offered by Base44 that are appropriate to the Services and our obligations.

Where PhuseDraft's technical architecture changes, this Privacy Policy may be updated to reflect the relevant processing.

9. Service Providers and Subprocessors

To operate PhuseDraft, we may use third-party providers for services including:

Additional providers may be used as the Services develop.

Where a provider processes personal information on PhuseDraft's behalf, we seek to use appropriate contractual, technical, and organisational safeguards.

10. Payment Processing Through Dodo Payments

Dodo Payments processes payment and transaction information associated with PhuseDraft subscriptions and purchases.

Dodo Payments maintains its own Privacy Policy and Data Processing Agreement.

Dodo's current DPA distinguishes between circumstances where Dodo acts as a processor on behalf of a merchant and circumstances where Dodo acts as an independent controller for its own processing activities.

Dodo Payments states that, when acting as a processor, it may process information including identification data, contact information, transaction metadata, online identifiers, commercial information, and support communications.

Dodo's current deletion policy states that data-deletion requests are generally processed within 30 days, although certain transaction-related information may be retained for legal, compliance, and fraud-prevention purposes.

Users should review Dodo Payments' privacy documentation for additional information concerning its independent processing activities.

11. Analytics and Tracking

PhuseDraft may use analytics and monitoring technologies to understand how users interact with the Services and to identify technical problems.

At the time this Privacy Policy was prepared, PhuseDraft's primary application infrastructure is provided through Base44.

Base44 states that its platform ecosystem includes analytics and monitoring services, including Google Cloud analytics infrastructure, DataDog logging, and other infrastructure services.

PhuseDraft will not represent a specific analytics provider as being used directly by PhuseDraft unless that provider is actually enabled within the PhuseDraft application or website.

If PhuseDraft later implements services such as:

  • Google Analytics;

  • Meta Pixel;

  • PostHog;

  • Mixpanel;

  • Hotjar;

  • Microsoft Clarity; or

  • Other analytics or advertising technologies,

we will update our applicable privacy and cookie disclosures where required.

Dodo Payments also provides optional integrations with Google Analytics 4, Google Tag Manager, and Meta Pixel for merchant-hosted pages. These tools should only be disclosed as being used by PhuseDraft if PhuseDraft actually enables them in its Dodo account.

12. Cookies and Similar Technologies

PhuseDraft and its infrastructure providers may use cookies, local storage, session technologies, pixels, or similar technologies to:

  • Maintain authentication;

  • Maintain security;

  • Remember preferences;

  • Operate essential features;

  • Analyse performance;

  • Diagnose technical issues; and

  • Improve the Services.

Where required by applicable law, we will obtain consent before using non-essential cookies or similar tracking technologies.

13. Data Retention

PhuseDraft does not apply one universal retention period to all information.

Retention depends on the type of information, why it was collected, and the technical and legal requirements applicable to that information.

Account Information

We generally retain account information while your account remains active.

Saved User Content

Your saved projects and User Content may remain in your account until you delete them or request account deletion.

AI Processing

OpenAI's standard API retention may involve retention of API inputs and outputs for up to 30 days for applicable API services, subject to endpoint-specific rules and configurations.

This does not mean PhuseDraft automatically deletes your saved projects after 30 days.

Temporary Technical Data

Temporary technical or processing data may be retained only for as long as reasonably necessary for processing, security, abuse prevention, troubleshooting, and system reliability.

Payment Records

Transaction and billing information may be retained by PhuseDraft and/or Dodo Payments for accounting, tax, fraud prevention, dispute resolution, regulatory, and legal purposes.

Backups

Deleted information may persist temporarily in encrypted backups or disaster-recovery systems until those systems are overwritten or securely deleted according to their normal retention cycle.

14. Deleting Your Account and Data

Where the functionality is available, you may delete projects or User Content through your PhuseDraft account.

You may also request deletion by contacting:

When we receive a valid deletion request, we will take reasonable steps to delete or anonymise personal information that we are not required or permitted to retain.

Deletion may not be immediate where information exists in:

  • Encrypted backups;

  • Disaster-recovery systems;

  • Security logs;

  • Fraud-prevention systems; or

  • Records that we are legally required to retain.

Where information must be retained, we will seek to limit its use to the purpose for which retention is required.

15. Security

PhuseDraft uses reasonable technical and organisational measures designed to protect your information.

Depending on the relevant system, these measures may include:

  • Encryption in transit;

  • Encryption at rest;

  • Authentication;

  • Access controls;

  • Role-based permissions;

  • Security monitoring;

  • Logging;

  • Backup protections;

  • Secure infrastructure;

  • Vulnerability monitoring; and

  • Incident-response procedures.

Base44 currently states that its platform uses TLS 1.2+ for data in transit and AES-256 encryption for data at rest, including backups.

OpenAI's API platform states that it maintains SOC 2 Type 2 certification and security controls for business/API customers.

These provider-level controls do not mean that PhuseDraft can guarantee absolute security.

No electronic transmission or storage system can be guaranteed to be completely secure.

16. International Data Processing

PhuseDraft is a U.S.-based company and may use service providers operating in multiple countries.

Your information may therefore be transferred to, stored in, or processed in countries other than the country in which you live.

Where applicable law requires safeguards for international data transfers, PhuseDraft will seek to implement appropriate contractual, technical, or organisational safeguards.

17. Your Privacy Rights

Depending on your location and applicable law, you may have rights including:

  • Access to your personal information;

  • Correction of inaccurate information;

  • Deletion of personal information;

  • Restriction of processing;

  • Objection to certain processing;

  • Withdrawal of consent where applicable;

  • Data portability;

  • Information regarding our processing activities; and

  • The right to lodge a complaint with an applicable regulatory authority.

18. Ghanaian Users

PhuseDraft, LLC is organized in New Mexico, United States, and is not incorporated as a Ghanaian entity.

However, PhuseDraft may have users located in Ghana and may conduct activities that could bring particular processing activities within the scope of Ghanaian data-protection law.

Where Ghana's Data Protection Act, 2012 (Act 843), applies to PhuseDraft's processing activities, PhuseDraft intends to comply with the applicable requirements of the Act.

This may include requirements relating to:

  • Lawful processing;

  • Transparency;

  • Data-subject rights;

  • Security safeguards;

  • Data retention;

  • International transfers;

  • Data-processing arrangements; and

  • Other applicable obligations.

PhuseDraft will assess its Ghanaian regulatory obligations based on the nature and location of its actual processing activities.

This section does not represent that every PhuseDraft processing activity is subject to Ghanaian law.

19. European and United Kingdom Users

If GDPR, UK GDPR, or another European privacy regime applies to PhuseDraft's processing of your information, you may have additional rights.

Where required, PhuseDraft will provide additional information regarding:

  • Legal bases for processing;

  • Data-subject rights;

  • International transfers;

  • Data processors;

  • Automated decision-making; and

  • Supervisory authorities.

20. United States Users

PhuseDraft is organized in the United States and may be subject to applicable U.S. federal and state privacy and data-security requirements.

Privacy rights vary among states.

Where applicable law provides additional rights, PhuseDraft will comply with the requirements applicable to the relevant user and processing activity.

PhuseDraft does not sell private User Content as a commercial data product.

21. Children's Privacy

PhuseDraft is not intended to knowingly collect personal information from children where such collection is prohibited by applicable law.

If you are below the minimum age required to use the Services in your jurisdiction, you should not create an account or provide personal information unless the required parental or legal authorisation has been obtained.

If we become aware that we have collected personal information from a child in circumstances where collection was not permitted, we will take reasonable steps to delete it.

22. Data Breaches and Security Incidents

If PhuseDraft becomes aware of a personal-data breach or security incident, we will take reasonable steps to:

  1. Investigate the incident;

  2. Contain and remediate it;

  3. Assess the information affected;

  4. Implement appropriate corrective measures; and

  5. Notify affected individuals and/or regulators where required by applicable law.

The timing and scope of any notification will depend on applicable legal requirements and the circumstances of the incident.

23. Third-Party Websites and Services

PhuseDraft may contain links or integrations to third-party websites and services.

Third-party services operate under their own terms and privacy policies.

PhuseDraft is not responsible for privacy practices of third parties that it does not control.

24. Business Transfers

If PhuseDraft becomes involved in a merger, acquisition, financing, restructuring, sale of assets, bankruptcy, or similar transaction, personal information and User Content may be transferred as part of that transaction where legally permitted.

Any such transfer will remain subject to applicable confidentiality and privacy requirements.

25. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect:

  • Changes to the Services;

  • Changes to our data-processing practices;

  • New service providers;

  • Changes to technology;

  • Changes in applicable law;

  • Changes in security practices; or

  • Regulatory requirements.

When material changes are made, we may notify users through the Services, by email, or through another reasonable method.

The updated Policy will state its effective date.

27. Our Commitment to Writers

PhuseDraft exists to help writers develop their stories.

We do not claim ownership of your creative work merely because you use our platform.

We do not intentionally use your private User Content to train publicly available foundation AI models through our OpenAI API integration.

We seek to minimise unnecessary data collection, use appropriate security safeguards, and retain information only for legitimate operational, legal, security, and business purposes.
