PhuseDraft AI Terms

These AI Terms (“AI Terms”) govern your use of artificial intelligence and machine-learning features provided through PhuseDraft, LLC (“PhuseDraft,” “we,” “us,” or “our”).

These AI Terms form part of the PhuseDraft Terms of Service. By using an AI-powered feature of PhuseDraft, you agree to these AI Terms in addition to the Terms of Service and Privacy Policy.


1. AI Features

PhuseDraft uses artificial intelligence to provide certain creative-development features, which may include:

  • Story ideation;

  • Logline generation;

  • Synopsis development;

  • Character development;

  • Story structure recommendations;

  • Beat-sheet generation;

  • Scene development;

  • Screenplay outlining;

  • Rewriting and refinement;

  • Brainstorming;

  • Summarisation;

  • Creative analysis; and

  • Other AI-assisted writing functions.

AI features may change, improve, or be discontinued as PhuseDraft develops.


2. OpenAI API

PhuseDraft currently uses the OpenAI API to provide certain AI-powered features.

When you request an AI-powered operation, information reasonably necessary to fulfil that request may be transmitted to OpenAI.

This may include:

  • Prompts;

  • Story information;

  • Character information;

  • Beat-sheet information;

  • Relevant User Content;

  • Instructions;

  • Previous generated material necessary for context; and

  • Other information required to generate the requested output.

PhuseDraft does not use consumer ChatGPT accounts to provide the application's AI functionality.

3. AI Data and Model Training

PhuseDraft does not intentionally submit private User Content to OpenAI for the purpose of training publicly available foundation models.

OpenAI states that API inputs and outputs are not used to train its models by default, subject to applicable policies, configurations, and exceptions.

PhuseDraft does not intentionally opt into OpenAI programs that permit our customers' private prompts, User Content, or API outputs to be used to train OpenAI's general-purpose models.

However, AI processing occurs through third-party infrastructure. Information transmitted to OpenAI may therefore be processed according to OpenAI's applicable API terms, security controls, retention policies, and contractual arrangements.


4. AI Processing and Retention

OpenAI's standard API data-retention practices may involve retention of API inputs and outputs for up to 30 days for purposes such as abuse monitoring, subject to endpoint-specific rules and available configurations.

PhuseDraft's own retention of User Content is governed by the PhuseDraft Privacy Policy.

The OpenAI retention period should therefore not be interpreted as PhuseDraft's general project-retention period.

Where available and appropriate, PhuseDraft may use reduced-retention or Zero Data Retention configurations for eligible OpenAI services.


5. AI Inputs

You are responsible for the information you submit to an AI feature.

You represent that you have the necessary rights and permissions to submit the information.

You should not submit:

  • Confidential information belonging to another person without authorisation;

  • Trade secrets that you are not authorised to disclose;

  • Personal information that you do not have a lawful basis to provide;

  • Credentials, passwords, authentication tokens, or financial account information;

  • Highly sensitive information unless necessary and lawfully permitted; or

  • Material that you do not have the right to process.


6. AI Outputs

AI-generated material (“AI Output”) may include text, ideas, characters, plots, scenes, outlines, dialogue, summaries, recommendations, or other material generated in response to your inputs.

AI Output is generated algorithmically and may be:

  • Incorrect;

  • Incomplete;

  • Inconsistent;

  • Repetitive;

  • Factually inaccurate;

  • Inappropriate;

  • Similar to existing material; or

  • Unsuitable for your intended purpose.

You are responsible for reviewing AI Output before relying upon, publishing, distributing, submitting, or commercialising it.


7. AI Output Is Not Guaranteed to Be Unique

Because artificial intelligence systems generate outputs based on learned patterns and statistical relationships, similar inputs may produce similar or substantially similar outputs.

PhuseDraft does not guarantee that AI Output will be unique to you.

Another user may receive an output that is similar to material generated for you.

This does not mean that PhuseDraft intentionally disclosed your private User Content to that user.


8. Intellectual Property and AI Output

PhuseDraft does not claim ownership of AI Output solely because it was generated through the Services.

However, whether AI Output qualifies for copyright or other intellectual-property protection depends on applicable law and the circumstances in which the material was created.

Factors may include:

  • Human authorship;

  • Human creative contribution;

  • Originality;

  • The nature of the AI-generated material; and

  • The applicable jurisdiction.

Accordingly, PhuseDraft does not guarantee that AI Output:

  • Is copyrightable;

  • Is exclusively owned by you;

  • Is protectable in every jurisdiction;

  • Is free from third-party claims; or

  • Can be registered as intellectual property.

You are responsible for determining the legal status of material you create using PhuseDraft.


9. Human Review

PhuseDraft is an assistive creative tool, not a replacement for human judgment.

You should review AI Output for:

  • Accuracy;

  • Originality;

  • Continuity;

  • Character consistency;

  • Copyright concerns;

  • Factual claims;

  • Cultural sensitivity;

  • Defamation risks;

  • Legal compliance; and

  • Suitability for your intended audience.

You remain responsible for the final work you create and distribute.


10. AI Does Not Provide Professional Advice

PhuseDraft's AI features are not intended to provide:

  • Legal advice;

  • Medical advice;

  • Financial advice;

  • Mental-health treatment;

  • Professional tax advice;

  • Professional investment advice; or

  • Other regulated professional advice.

Where AI Output concerns these or other high-stakes subjects, you should consult an appropriately qualified professional.


11. Prohibited AI Uses

You may not use PhuseDraft's AI features to:

  • Generate malware or malicious code;

  • Facilitate fraud;

  • Facilitate identity theft;

  • Circumvent security systems;

  • Generate content intended to facilitate unlawful activity;

  • Infringe another person's intellectual-property rights;

  • Generate or distribute non-consensual intimate material;

  • Harass or threaten individuals;

  • Attempt to obtain another person's private information;

  • Circumvent platform safeguards;

  • Conduct automated abuse of the Services; or

  • Otherwise violate the PhuseDraft Terms of Service or Acceptable Use Policy.


12. AI Availability

AI features depend on third-party infrastructure and may occasionally be unavailable.

PhuseDraft does not guarantee uninterrupted access to AI features.

AI features may be temporarily limited because of:

  • OpenAI service interruptions;

  • Infrastructure failures;

  • Rate limits;

  • Maintenance;

  • Security incidents;

  • Abuse prevention;

  • Technical changes; or

  • Other circumstances outside PhuseDraft's reasonable control.


13. AI Usage Limits

PhuseDraft may impose reasonable limits on AI usage based on:

  • Subscription plan;

  • Credits;

  • Usage quotas;

  • Rate limits;

  • System capacity;

  • Abuse-prevention requirements; or

  • Other operational considerations.

We may modify usage limits where reasonably necessary to maintain the Services.


14. Third-Party AI Providers

PhuseDraft may use additional AI providers in the future.

If we materially change the way AI providers process User Content, we may update our Privacy Policy, these AI Terms, or other applicable disclosures.

The current AI provider identified for PhuseDraft's principal AI functionality is:

15. AI Safety and Abuse Monitoring

PhuseDraft may monitor limited information necessary to:

  • Detect abuse;

  • Prevent fraud;

  • Protect users;

  • Investigate security incidents;

  • Enforce our Terms; and

  • Maintain the integrity of the Services.

Such monitoring will be conducted in accordance with applicable law and our Privacy Policy.

16. No Warranty Regarding AI Output

To the maximum extent permitted by law, AI features and AI Output are provided on an “as is” and “as available” basis.

PhuseDraft does not warrant that AI Output will be:

  • Accurate;

  • Complete;

  • Original;

  • Suitable for publication;

  • Commercially usable;

  • Copyrightable;

  • Legally compliant; or

  • Free from third-party claims.

17. Changes to AI Features

PhuseDraft may modify, replace, suspend, or discontinue AI features.

This may occur because of:

  • Improvements to the Services;

  • Changes to AI technology;

  • Provider changes;

  • Security requirements;

  • Legal requirements;

  • Cost considerations; or

  • Operational requirements.
